Why We Made This:

  • Legal and ethical challenges are often overwhelming. Individuals are frequently unsure how to handle subpoenas, testify in court, or differentiate between confidentiality and privilege. Forensic content is nuanced but underrepresented in many training programs. We wanted to fill that gap with clear, digestible explanations and practical steps. This PDF helps demystify the process and encourages ethical consultation and legal collaboration.

Learning Objectives:

  • Understand the role of forensic psychologists across various capacities: advisor, consultant, examiner, negotiator, and expert witness.
  • Describe key ethical responsibilities, including integrity, competence, and knowledge of the legal system.
  • Recognize and manage ethical dilemmas, such as conflicts of interest and dual relationships.
  • Differentiate between fact witnesses and expert witnesses, including their qualifications and the types of testimony they can provide.
  • Explain the differences between privilege and confidentiality, insanity and competence, and assent and consent in forensic contexts.
  • Understand the types of subpoenas (witness, duces tecum, and deposition) and how to respond to them ethically and legally.
  • Apply structured steps to respond to subpoenas across multiple scenarios, including when clients grant or withhold consent, when court orders are received, or when clinical judgment raises concerns.

Outlined Notes: Forensics, Subpoenas, Testimonies & Legal Terms
